Welcome to JhalakAI, operated by Capslock Marketplaces Private Limited ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the JhalakAI mobile application, website, and all related services ("Service").

By using the JhalakAI app, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use JhalakAI. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into a binding agreement.

2. Account Registration

To access premium features, you must register with your mobile number and complete OTP verification. You are responsible for maintaining the confidentiality of your login details and for all activity under your account.

3. Subscription and Payments

JhalakAI is a subscription-based service.

• We offer plans with AutoPay functionality, enabling seamless recurring payments via UPI or other supported methods.
• By subscribing, you authorize us to automatically charge the payment method linked to your account until you cancel.
• You can cancel AutoPay at any time via your UPI app or in-app subscription settings.
• No refunds will be issued for partial months or unused time unless required by law.

4. User Conduct

You agree to:

• Use JhalakAI only for lawful and educational purposes
• Not misuse, reverse-engineer, or exploit any part of the platform
• Not post or transmit harmful, abusive, or misleading content
• Not interfere with or disrupt the functioning of the app

Violation of these rules may result in suspension or permanent termination of your access.

5. AI Voice & Practice Features

JhalakAI offers interactive AI-powered features including reading, speaking practice, and simulated phone calls.

• Your voice inputs may be used to improve your learning experience.
• We do not store or share these recordings with third parties unless explicitly stated.
• These features are intended for individual use only, not for commercial or broadcast purposes.

6. Intellectual Property

All content, branding, code, and designs in JhalakAI are the exclusive property of Capslock Marketplaces Private Limited.

• You may not reproduce, distribute, or create derivative works without prior written consent.
• "JhalakAI" and associated marks are trademarks owned by us.

7. Service Availability

We aim to keep JhalakAI running smoothly but do not guarantee uninterrupted access. The app may undergo maintenance, updates, or experience technical issues from time to time.

We are not liable for any loss due to service interruptions or delays.

8. Termination

We reserve the right to suspend or terminate your access at our sole discretion if you violate these Terms or misuse the platform.

You may discontinue your subscription and delete your account at any time.

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• We do not guarantee specific learning outcomes or fluency results
• The Service is provided "as-is" without warranties of any kind

10. Changes to Terms

We may update these Terms from time to time. We'll notify you of significant changes via the app or email. Continued use after changes implies your acceptance.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka.
